Federal Cabinet Approves Extension of Licenses for Explosives Export and Import Firms

The Federal Cabinet has approved the extension of licenses for four firms involved in the export and import of explosives, following the fulfillment of all codal formalities and prerequisites. This decision, facilitated by the Petroleum Division, underscores the government’s commitment to maintaining safety and regulatory compliance in the handling of explosives and hazardous materials.

The Petroleum Division informed the Cabinet about the role of the Department of Explosives (DoE), which operates under its administrative control. The DoE is tasked with ensuring public safety across all stages of manufacturing, transportation, storage, import, export, sale, and use of explosives, petroleum products, and hazardous chemicals within Pakistan. This rigorous oversight ensures adherence to safety protocols and regulatory frameworks.

In a letter dated September 20, 2023, the DoE requested federal government approval to extend existing licenses in Form EL-01 for the following firms engaged in manufacturing high-density commercial explosive materials:

  1. M/s Waah Associates
  2. M/s Jamhex Company Private Limited
  3. M/s Wah Nobel Detonators Private Limited
  4. Araka Enterprises (Pvt) Ltd

According to the Explosives Rules, 2010, the Chief Inspector (currently the Director General of Explosives) holds the authority to grant licenses in Form EL-01. However, amendments to these licenses require federal government approval under Rule 111(1)(b). This provision mandates that no license in Form EL-01 can be amended without explicit federal authorization.

The Petroleum Division initially submitted this matter to the Federal Cabinet on February 19, 2024. During the review, the Cabinet directed the Petroleum Division to secure clearances from the Ministry of Defence, Ministry of Defence Production, and Ministry of Interior before resubmitting the case. Following these directives, the relevant ministries were approached in March 2024.

  • Ministry of Interior: Provided a no-objection certificate (NOC).
  • Ministry of Defence Production: Issued clearance for the amendments.
  • Ministry of Defence: Clarified that the matter does not fall under its purview.

These responses paved the way for resubmitting the case for final Cabinet approval.

The Petroleum Division, after fulfilling all application and procedural requirements, presented the case to the Federal Cabinet. It was certified that all codal formalities, including prerequisites for amending licenses under the Explosives Rules, 2010, had been met. Consequently, the Cabinet approved the amendments in the licenses for the specified firms.

The extension of these licenses reflects the government’s dedication to balancing industrial needs with public safety. By adhering to stringent regulatory procedures and inter-ministerial coordination, the authorities have ensured compliance with national and international safety standards.
